Today’s post is just a quick summary of some of the information you should be gathering if you are handling your own personal injury claim. Generally, you should just try to gather any piece of evidence that relates to your injury claim or exists because of your injury claim. Even minor items like receipts for prescriptions, emails to your health care provider, etc. can be helpful to your claim.
- Demographic and Background Information (e.g., social security number, date of birth, address, place of employment, marital status, parental status, medical history, work history, criminal background, driving record, etc.). When you present your claim to the insurance company you want to give the most favorable snapshot of yourself, so be sure to gather any piece of information that presents you in a positive light or shows how difficult your injury has made your life.
- Information about the incident (e.g., location of the accident, date of the accident, description of the accident, witnesses to the accident, etc.). Any piece of evidence that can shed light on the incident that caused your injury will be relevant and helpful.
- Insurance Information (e.g., at-fault party’s liability insurance carrier, client’s health insurance carrier, client’s homeowner’s insurance or automobile insurance carrier, etc.). Gathering insurance information is important because if you are incurring medical bills you may be able to get your medical bills paid now, which will help you avoid receiving annoying phone calls from the billing department of your health care provider.
- Retainer Agreements (e.g., fee agreement, engagement agreement, HIPAA medical release, etc.). To the extent that you hire anyone to assist you with your claim (whether that be an auto repair facility, a Durham Personal Injury Attorney or a Greensboro Personal Injury Attorney, chiropractor, physical therapist, etc.) be sure to hang on to all agreements that you sign.
- Medical documents (e.g., bills, medical records, etc.). Obtaining copies of all of your medical bills and medical records is crucial. You will need to present this information to the insurance company (or jury) in order to receive compensation. Be sure to review these documents closely to make sure that the information is accurate (and consistent with what you remember from your visit).
- Photographs (e.g., of injuries, of injury scene, of property damage, etc.). Photographs of your injuries, the accident scene, etc. are a very powerful piece of evidence in your case.
- Other documents (e.g., accident report, W-2/tax returns (for wage loss claim), pay stubs (for wage loss claim), letter from HR representative (for wage loss claim), etc.).
